In the first day of what was to have been the second trial involving Rose Marie Kuehni, Judge James Duvall announced a sentence has rendered following a guilty plea by Kuehni to aggravated battery in the shooting death of then boyfriend Douglas Bailey, of Prescott. Duvall sentenced Kuehni to five years in prison, but stayed imposition exchanging the prison term for 10-years of probation instead. Baileys family, who were in the courtroom, disagreed with the outcome, providing a much different view of the victim and disputing allegations of the long term abuse pattern Kuehni was said to have endured. Kuehni will receive a year in jail, but will be given credit for the 277 days already served as well as credit for good behavior during her incarceration. It is possible that she will not be required to serve out the remainder of that time. The case continues as Kuehni was found guilty of hiding a corpse at the conclusion of the first trial, although sentencing was postponed until the outcome of the second trial was made known. Nothing was revealed about the status of that sentence. Another facet of the case is another defendent, Clarence Hicks, who will appear on December 12th in Pierce County Court where he will stand trial for his part in the disposal of Bailey’s body following the killing, receiving two boxes from Kuehni which contained Bailey’s body and belongings which Hicks rolled down a steep ravine in Kentucky. The boxes were discovered and investigations tied Kuehni to Hicks , who was involved in a relationship prior to Bailey’s death.
