KDWA is following continuing news of a story we reported last week. The results announced by a canvassing board regarding disputed ballots in the 96.5 million dollar levy question in South Washington County School District 833 have been challenged. Attorney Erick Kaardal, the lawyer for the anti-levy group Citizens for Progress points to 5 ballots that were rejected due to abnormal marking of the voter’s response. The law states that the board can only reject a ballot if it is impossible to determine the intent of the voter. Had those ballots counted, the vote would have been tied at 6, 840 yes and an equal amount no. In this case, a tie would mean defeat of the levy which was presented in the election held November 3rd. The district contends that rejection of those five were warranted. A hearing on the challenge is required within 20 days of the challenge. KDWA will have the result of that hearing as soon as it is known.
